To March-In or Not March-In: That is the Question

Join us for an expert panel discussion of an under-appreciated but potentially powerful right in federally-funded inventions.

Since 1980, the Bayh-Dole Act has enabled businesses (large and small), non-profit organizations, and academic institutions to obtain title to patents resulting from inventions developed through federal grants.  In exchange, the U.S. Government retains certain rights and control over these patents -- including the right to “march in” and compel licensing of the patented invention in any field of use, if certain conditions are not met.

This panel will survey the meaning and potential impact of this latent governmental power, including:

  • When march-in can happen, and the probability of it happening. 
  • Petitions in which the government was asked to “march in.”
  • New interpretations that threaten to expand the scope and reach of march-in authority.

While March-In Rights loom across many industries, certain advocates are using new interpretations of March-In Rights to propose wide-ranging governmental price controls on patented products. Is this appropriate?  Or does such a step misconstrue the Bayh-Dole Act and potentially reduce or eliminate incentives for using federal funds for important research, particularly when the researcher has made significant investments in the patented invention?
