An overview of antitrust law in IP litigation, including:
How Section 2 can be used to curb illegitimate patent monopolies via Walker Process claims (against enforcement of fraudulent patents), sham litigation claims (against enforcement of invalid patents), and broader claims (e.g., acquiring patents or leveraging them in long-term exclusive contracts). How Section 1 can be used to limit improper multilateral conduct, such as exclusionary licensing, no-poach agreements, and abuse of standard essential patents.
